How do I fix a bad real estate deal?
I am stuck with rental property that people I trusted received "kick back" money and I can not rent or sell it. I have gotten further into debt by trying to rehab it and still can't rent or sell it, If I short sell it, I will still be $50,000 to $60,000 in debt which includes a home equity loan on my own home. I can't get out of the 5 year ARM loan. After 5 years it will be an adjustable rate loan. I feel my only way out is bankrutcy. I don't want to lose my daughter's college IRA or my deferred compensation or my house.
You raise a lot of issues with limited information. You are right that a second TD can come after you for a deficiency balance, which will haunt you for up to seven years as a collection account. Whether this actually costs you money depends on how aggressive is the collection agency, the amount you owe, and your attempts to settle the debt.
If you know that you have no equity in the property, then a short sale is probably your best bet. The holder of the second may take as little as 10% as satisfaction, which gets you off the hook for a deficiency, and the holder of the first may drop to 65% or even less, depending on the debt owed and your market conditions.
Unfortunately, a lender usually won't talk about a short sale until you are three months behind in your payments, which means that your credit has already suffered.
You might look at renting it at a cash flow loss for the short term, in order to limit your exposure and maintain your credit. I don't know if you have any money to throw at it, but it may be an option.
It seems that you referred to an ARM on your own home, which I suppose means you took money out of your residence in order to purchase the new property, which now has no value to support your investment? This is a larger problem, and you might just have to eat that one.
Perhaps, you can move into the rental and sell your own house on a short sale? I would need more specific information from you in order to help you further.
